DOT 'Medical' Marijuana Notice - Department of Transportation

With regards to legalized marijuana and it's use in safety sensitive transportation employees (pilots, aircraft maintenance personnel, ship captains, bus and truck drivers, train engineers, subway operators, transit fire-armed security and pipeline emergency response personnel and others, the DOT has made it clear that its Drug and Alcohol Testing Regulation-49CFR Part 40 does NOT authorize medical marijuana under state law to be a valid medical explanation for a transportation employee's positive drug test result.  In other words, those who have asked this question or wondered about it, NO you will not be "excused" if you have a positive drug test for marijuana if you are a safety sensitive employee, regardless if it's legal in your state.
